International
If the passenger's flight includes as a destination or a stop in a country other than the country of
departure, the Convention for the Unification of Certain Rules relating to International Air Transport
or the Warsaw Convention and its modifications may be applicable and it regulates and at the same time
limits the responsibility of the carrier for death and/or damage and injury to the passenger and for the
loss or damage of baggage. See the carrier's General Contract Conditions for information on liability
limitations for death and/or damage and injury to passengers and for loss or damage to luggage.
National
For transportation contracts or flights within the territory of the Republic of Guatemala, the liability
and obligations of the carrier are subject to the General Contract Conditions of the carrier, the Civil
Aviation Law and its Regulations, and other Civil Aviation regulations that are applicable. See the
carrier's General Contract Conditions for information on liability limitations for death and/or damage
and injury to passengers and for loss or damage to luggage.
The General Conditions of Contract of the carrier are incorporated by reference and form part of this
contract of carriage. ALL TICKETS ISSUED OR PACKAGES ISSUED ARE NON-REFUNDABLE UNDER NO CIRCUMSTANCES,
THE CLIENT WAIVES TO REQUEST ANY TYPE OF REFUND FOR TICKETS OR PACKAGES PURCHASED REGARDLESS OF THE
PAYMENT METHOD. THE CUSTOMER WAIVES FROM REQUESTING ANY TYPE OF CHARGE FOR THE PURCHASE OF AIR TICKETS
OR PACKAGES MADE WITH A CREDIT OR DEBIT CARD ON THE TRANSPORTES AEREOS GUATEMALTECOS S.A. WEBSITE, AS
WELL AS THROUGH THE NON-PRESENTIAL PAYMENT LINK. THE CUSTOMER AGREES THAT THE TRANSACTIONS ON THE
WEBSITE ARE NOT PERSONAL, THEREFORE HE WAIVES TO REQUEST AGAINST CHARGES. GENERAL CONDITIONS OF
CONTRACTING TRANSPORTES AEREOS GUATEMALTECOS, SOCIEDAD ANÓNIMA (-TAG-): 1. For the purposes of this
contract, ticket or ticket refers to this plane ticket and the baggage check of which these conditions
and notifications are part; carrier means all carriers or carriers who carry or undertake to carry the
passenger and his baggage under this contract or to provide any other service incidental to this
contract of air carriage; and Warsaw Convention, means the Convention for the Unification of Certain
Rules Relating to International Air Carriage signed at Warsaw, Poland on October 12, 1929, or that
Convention as modified by subsequent treaties, whichever may be ) applicable. 2. This air transportation
contract is subject to the rules and liability limitations established in the Warsaw Convention and its
amendments, except that air transportation is not international transportation as defined by said
Convention. The incorporated terms, rules and limitations of liability include, but are not limited to:
a) Rules, regulations and limits regarding the carrier's liability for personal injury or death; b)
Rules, norms and limits of liability of the carrier for damage to baggage; c) Rules and restrictions on
the procedural actions that the passenger can bring against the carrier, as well as expiration periods
for the actions that the passenger can bring against it; d) The rights of the carrier to change the
terms of the contract; e) Norms and rules on the reconfirmation of reservations, on registration or
check-in and on the power of the carrier to deny transportation to the passenger; and on f) the
limitations of liability of the carrier for the delay or delay in the arrival of luggage. 3. In the
event that the contract is not subject to the Rules of the Warsaw Convention, this contract is subject
to these General Conditions of Contract, the Civil Aviation Law of Guatemala and its Regulations, and
other Aviation regulations. Civil that are applicable. 4. To the extent that these General Contract
Conditions are not inconsistent, transportation and any other service provided by any carrier is subject
to: i) the stipulations of this ticket or ticket; ii) the applicable rates; iii) the General Contract
Conditions of the carriers involved and related stipulations and rules, which are incorporated by
reference to this contract; and iv) applicable laws and regulations. 5. Any limitation of liability
applicable to Transportes Aéreos Guatemaltecos, Sociedad Anónima or any carrier shall also apply to its
employees, dependents, executives, representatives, agents and/or agents. 6. No employee, dependent,
executive, representative, agent and/or agent of Transportes Aéreos Guatemaltecos, Sociedad Anónima, of
any carrier, or even the passenger himself, is entitled to modify, alter or waive any of the provisions
or stipulations of the present contract. 7. Any exclusion or limitation of liability that benefits
Transportes Aéreos Guatemaltecos, Sociedad Anónima shall be understood to apply and benefit its agents,
employees, executives, representatives and dependents. Likewise, the same exclusions or limitations of
liability will apply to aircraft lessors or to any person who by any title or contract Transportes
Aéreos Guatemaltecos, Sociedad Anónima uses its planes or aircraft for transportation, as well as its
agents, employees, executives, representatives and their dependents. 8. Checked baggage will be
delivered to the bearer of the baggage receipt or check. 9. In the event of damage or failure to luggage
in international transport, the claim must be made in writing to the carrier immediately after
discovering the damage or failure and, at most, within seven days of receipt of the luggage.10. In
national transportation, in the event of a breakdown or partial loss, the addressee must submit his
claim to the carrier within a period of five (5) days, counted from the date of delivery. In the case of
loss or destruction, the claim must be made within the same periods, but counted from the date on which
the carrier communicates to the owner of the baggage that the loss has occurred, or on the date on which
the baggage should have been placed for sale. disposition of the consignee or owner of the baggage. In
case of delay in delivery, the claim must be made within the same periods, counted as follows: a)
Baggage transported in the same aircraft as the passenger, from the date of arrival of the passenger at
the destination aerodrome, and b) Unaccompanied baggage, from the date the carrier informs the owner or
recipient of the arrival of the baggage. 11. This ticket, except for what is expressly provided for, is
valid for one year from the date of issue. Payment of the fee may vary prior to the start of
transportation, and the carrier shall have the right to refuse or deny transportation to the passenger
in the event that the applicable fee has not been paid. 12. The carrier hereby undertakes to make its
best efforts to expeditiously transport the passenger and his luggage. The carrier cannot guarantee the
flight times displayed at the airport or elsewhere, and therefore they do not form part of this
contract. The carrier reserves the right to substitute alternate carriers or aircraft, and may alter or
omit stops listed on the ticket if necessary. Hours are subject to change and may be modified without
prior notice. The carrier is not responsible for making connections. 13. The passenger must comply with
national and foreign government regulations on, among others, travel documents necessary for entry and
exit from one country to another or within the territory of a state. 14. The passenger must appear at
the carrier's facilities two hours before for domestic flights and three hours for international
flights. 15. The passenger must present the ticket issued by the carrier. 16. If the passenger changes
the date, he will have a penalty according to the fare he has purchased; this can range from $49 to $100
plus the fee adjustment. 17. The passenger's baggage must weigh a maximum of twenty (20) pounds. The
carrier may charge three United States dollars ($3.00) for each pound of baggage in excess of the twenty
pounds that are allowed as the maximum weight of each passenger's baggage. 18. The carrier's aircraft is
insured in accordance with the relevant international, national and civil aviation regulations for an
amount that covers the entire liability of the carrier under the legal regulations in case of death or
personal injury of the passengers and expenses doctors. 19. The carrier does not assume responsibility
for: a) baggage that is overloaded or overfilled; b) Baggage that was already damaged prior to being
delivered for transportation; c) minor damage to baggage resulting from normal wear and tear; d) loss of
or damage to baggage i) that the passenger carries in the passenger cabin, ii) photographic equipment,
computers or any electrical equipment, jewelry, cash, documents, works of art or other property or
valuables. 20. The carrier does not assume responsibility for the loss or damage of fragile or
perishable objects or goods. 21. The carrier will not allow on board or for transportation dangerous
goods or materials, such as explosives, compressed air, flammable solids and liquids, oxidizers,
infectious or toxic, corrosive or radioactive substances. 22. The passenger waives any type of claim for
punitive damages or of any kind against the carrier and fully accepts the liability limitations that the
carrier enjoys under current international and national regulations. 23. The passenger waives the
jurisdiction of his domicile and submits for any dispute arising from or related to this contract to the
courts of the Republic of Guatemala. 24. In the event that any term or condition of this Agreement is
declared void or illegal for any reason, this Agreement will remain in full force and effect in the
other terms and will be interpreted as if such void or illegal term or condition were not part of it,
except that the nullity of the null, annulled or declared illegal clause makes the contract useless in
its entirety. BAGGAGE RESPONSIBILITY: 25. We do not accept responsibility for minor cuts, nicks or
scratches commonly incurred in handling luggage or lost wheels, handles, straps and other accessories.
Nor do we accept responsibility for the rupture of any compartment or its contents, nor the rupture of
the seams, closures or others. Maximum liability for loss or damage to a bag and its contents is based
on IATA regulations. 26. ALL FLIGHTS CLOSE 45 MINUTES BEFORE THE FLIGHT DEPARTURE. 27. DATE CHANGES
WITHIN 4 HOURS BEFORE THE DEPARTURE OF THE FLIGHT WILL HAVE A PENALTY OF $100 + RATE ADJUSTMENT. 29. IF
THE PASSENGER IS A NO SHOW EITHER AT THE AIRPORT AT THE COUNTER FOR APPEARING WHEN THE FLIGHT IS ALREADY
CLOSED OR THE PASSENGER WAS CHECKED BUT IS LATE AT THE BOARDING GATE, THEY WILL HAVE UP TO 4 HOURS AFTER
HAVING BEEN A NO SHOW TO RESCHEDULE THEIR FLIGHT WITH A PENALTY OF $100 USD. OUT OF 48 HOURS THE TICKET
WILL BE LOST.
